Overview

Data privacy within healthcare is facing several significant issues at present. The Office for Civil Rights (OCR) has significant interest in improving observance of individual’s right of access, which is reflected in the settlement agreements of the past three years and in the Privacy Rule Notice of Proposed Rulemaking (NRPM). The Privacy Rule NPRM may cause organizations to need to rework how workflow and processes are managed to ensure individual rights of access are observed.

At the same time, the Information Blocking Final Rule imposes requirements that add to the challenge, especially in the area of minors and their privacy rights for care that does not require parental consent.

Hovering over everything is the issue of whether it is time to consider a national privacy law that moves beyond the current, more sectoral approach.
