The rule represents a significant change in the landscape of HIPAA Privacy requirements. The Privacy Rule always has been focused on establishing reasonable guardrails, allowing, but not requiring, healthcare providers to make certain classes of disclosures. For the first time, a rule change is prohibiting disclosures to certain entities and business associates when it involves reproductive healthcare.
